ATV OPERATOR ARRESTED FOR 2ND
DUI AND DRIVING WITH A SUSPENDED LICENSE
WATERBURY, VT -- A Barnet
man is facing serious charges after being caught driving an
ATV on a local town road while intoxicated and after his
driver's license was suspended.
On the evening of March 27,
Easter day, Richard L. Moon, 51, of Barnet was arrested for
DUI and criminal DLS. Vermont State Game Warden Dennis
Amsden stopped Moon for operating an ATV on the Barnet
Center Road, in Barnet, VT. The roads in Barnet are not open
to ATV use. Moon showed signs of intoxication. Warden Amsden
charged him with driving under the influence and driving
with a suspended license.
Moon's blood alcohol level
was .208, greater than 2 ½ times the legal alcohol limit.
Moon was previously convicted of DUI in 1998.
A conviction for a second
offense of DUI carries a fine of not more than $1,500 and a
jail sentence of not more than two years. A conviction of
criminal DLS carries a fine of not more than $5,000, plus
surcharge, and a jail sentence of not more than two years.
